James W. Upton

corpus christi law firm Jim has been trying cases in South Texas since 1990 and has received verdicts from Brownsville (Cameron County) to Laredo (Webb County) to Carrizo Springs (Dimmit County) to San Antonio (Bexar County) to Victoria (Victoria County) to Port Lavaca (Calhoun County) to Rockport (Aransas County) to Corpus Christi (Nueces County) and many other South Texas counties.   The majority of these cases have involved personal injury and death claims resulting from traumatic events associated with automobile/trucking accidents, industrial accidents and product liability claims.

Although some cases have to proceed to trial for various reasons, Jim's extensive trial experience representing both plaintiffs and defendants convinced him that many more cases should be resolved prior to the reading of the jury's verdict.   Therefore, in an attempt to assist litigants in resolving their disputes prior to the accrual of substantial litigation costs and the usual all or nothing jury verdict, in 2010, Jim became a certified mediator.   With his experience in negotiating and trying cases in all of South Texas, uniquely qualified to mediate or arbitrate cases involving automobile/trucking accidents, product liability, insurance disputes, construction claims, first party claims, contract disputes and employment disputes.

Alternative Dispute Resolution

Like many other trial attorneys, Jim decided to add to his litigation experience and become a mediator after being involved in hundreds of mediations during his career.   Consequently in June of 2010, Jim became a certified mediator after attending training at the Dispute Resolution Center in Austin, Texas and has been conducting mediations and arbitrations in the firm's Corpus Christi and San Antonio offices since that time. Jim's experience in conducting mediations does not come from a simple certification; rather, it comes from being a trial attorney and trying civil cases to juries on behalf of plaintiffs and defendants in numerous South Texas venues such as Nueces, Aransas, Kleberg, Jim Wells, San Patricio, Hidalgo, Cameron, Webb, Bexar, Travis, Dimmit, Calhoun, Maverick, Medina, Victoria, Live Oak and Bee counties.

Jim's experience in representing clients on both sides of the docket, as many attorneys do as well, allows him to provide mediation and arbitration participants with a very well balanced approach and understanding of the mediation and arbitration participants' positions.   On a personal note, Jim has also been personally involved in litigation as both a plaintiff and defendant which has caused him to have a different perspective of our legal system after this personal involvement.  These experiences assist Jim to have a better understanding of a litigant's position during mediation and arbitration.

To assist you in your decision making process on selecting a mediator or arbitrator who is best suited for your pre-litigation, litigation or post litigation needs, a fee schedule link is provided below for your review and consideration.   Although mediations and arbitrations are primarily conducted in either the firm's Corpus Christi or San Antonio offices, Jim is always available to travel to any mutually agreed upon location to conduct your mediation and arbitration and assist in the resolution of your dispute.
